Terms of Service

1. About these terms
These Terms of Service ("Terms") govern your access to and use of the PlanIt website, applications, and related services (collectively, the "Service") provided by PlanIt ("PlanIt", "we", "us", "our"). By using the Service you agree to be bound by these Terms.
2. Eligibility and accounts
You must be of legal age in your jurisdiction and, if using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
3. The Service
PlanIt provides software for NDIS participants, nominees, support coordinators, and providers to manage plans, goals, services, documents, and communication. We may add, change, or remove features at any time. We do not guarantee that the Service will be uninterrupted or error-free.
4. Acceptable use
You must not, and must not allow others to:
- use the Service in violation of any law or regulation;
- engage in fraud, spam, or harassment;
- infringe intellectual property or privacy rights of others;
- upload malware, probe or interfere with security, or scrape the Service;
- reverse engineer, resell, or circumvent technical limits of the Service.
5. Your content
You retain ownership of the data and content you upload. You grant PlanIt a limited, non-exclusive licence to host, process, and display your content solely to provide the Service to you and the users you authorise.
6. Intellectual property
PlanIt, its software, documentation, and branding are owned by PlanIt and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refund mechanics are governed by Paddle's Buyer Terms and Refund Policy, in addition to our Refund Policy.
Subscriptions renew automatically for the chosen billing period unless cancelled before the renewal date. Pricing is shown at checkout in your local currency where supported.
8. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your access ends and we will delete or return your data in accordance with our retention practices.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. PlanIt does not provide legal, medical, or financial advice and is not affiliated with the National Disability Insurance Agency.
10. Liability
To the fullest extent permitted by law, our aggregate liability for any claims arising out of or in connection with the Service is limited to the fees you paid in the 12 months prior to the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death, or personal injury caused by negligence).
11. Indemnity
You agree to indemnify PlanIt against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Australia, and any disputes will be subject to the exclusive jurisdiction of the courts located there, unless mandatory local law requires otherwise.
